Person B would probably be more in the wrong, as the "fighting words" doctrine has been so damn inconsistent over the years as it pertains to cases like this. Chaplinsky v. New Hampshire opened up an total can of worms that has led the USSC, to the point where guys like Alito applied it to later cases where there could be grounds for it, such as Synder vs Phelps. But it's startling how inconsistent the courts rule with these types of issues. Morally and personally? I'd say person A easily. If you're trying to incite a violent reaction through your speech then I don't feel bad for the results if it escalates into violence. EDIT: Felt like this was a good clarification and differential between "fighting words" and "incitement", as both really are differing concepts, and why in one case it can be allowed while the other isn't according to the courts: The difference between incitement and fighting words is subtle, focusing on the intent of the speaker. Inciting speech is characterized by the speaker's intent to make someone else the instrument of his or her unlawful will. Fighting words, by contrast, are intended to cause the hearer to react to the speaker. --- |

There's less racial tension when people aren't exposed to reality of others and can live in their own bubbles. It's not the "blame" of any group and you'd be idiotic to say people didn't express or there wasn't an underbelly of racial tension in this country forever. But things like cell phones capturing images and social media pushing them, then the rise of basically anyone able to say any opinion on said subject matters and mass broadcast that is what made these things visible. People who act as if the 90s or 2000s were some mass time of racial harmony are deluding themselves to reality or simply too young to remember or recognize that. Or, like most people, they were isolated in their own world and oblivious to the problems and opinions of others. --- |

We already have had various Republican politicians, including guys like Steven King call for the ending of the amendment, or at least changing it to require one parent to be a legal US citizen. And in 2015 Trump on an interview he himself said he would work to eliminate birthright citizenship for children born in the United States to parents living here illegally, also claiming it may take two terms to fulfill this proposal. So do people in this country really feel that we as a society don't have enough left to achieve any tangible success as individuals in a nation, and that all of the issues plaguing the country have to do with outside influences and people taking these opportunities away from 'real' Americans? If so then what's the end game for those people that doesn't end with the total disenfranchisement and displacement of millions of people? --- |

The officer took in the girl for a time after meeting her at the school, and their relationship then turned sexual. Mesiti had pleaded guilty May 22 before another judge who has since retired, and the former officer agreed to register as a sex offender and face a sentence no greater than six months of incarceration and 10 years of probation, the newspaper reported. “I’m not comfortable with this,” said Sheldon, who faulted the former officer and his supporters for calling the victim’s statements into question. “Please be comfortable — I did it,” Mesiti told the judge. “There’s no sense in dragging my family, and this young lady, through this.” Sheldon nearly sent the case back to “square one” after Mesiti’s attorney suggested prosecutors had coerced the retired officer’s guilty plea by threatening his family, but the defense attorney apologized and claimed he misspoke.
